EXCURSION RELEASE AND WAIVER OF LIABILITY

Welcome to Shore Thing Escapes Ltd.! To make your experience more enjoyable and safer, we would like to tell you about our excursion and policies.  

IMPORTANT NOTICE: Shore Thing Escapes Ltd. (hereinafter the “Company”) excursion includes traveling from Nassau to Islands in The Bahamas on a powerboat across the open ocean and involves snorkeling and interaction with iguanas, pigs, marine life, including, sharks, turtles and stingrays. There are inherent risks involved with these types of activities, included but not limited to equipment failure, perils of the sea, harm caused by marine creatures (including bites), high seas, high speed, weather conditions, unforeseen mechanical problems, human error and accidents, acts of fellow participants, entering and exiting the water, boarding, or disembarking boat, alcohol consumption activities, drowning.  

IN CONSIDERATION of the Company permitting me to participate in this excursion, I acknowledge and agree as follows:  

I UNDERSTAND that this excursion has inherent risks included but not limited to all the risks listed and that by signing this release I accept all the risks of participating in any and all activities and hereby release the Company, its officers, directors, subsidiary companies, employees, servants, agents or independent contractors and their boats (whether owned, operated, leased or chartered), (collectively the “RELEASED PARTIES”),

AND AGREE TO INDEMNIFY, HOLD THE RELEASED PARTIES HARMLESS AND PROMISE NOT TO SUE FOR ANY DEATH, INJURY, PERSONAL LOSS, PERSONAL PROPERTY DAMAGE, OR FROM ANY AND ALL OTHER LIABILITIES ARISING AS A CONSEQUENCE FOR ANY ACT, OMISSION, NEGLECT OR DEFAULT ON THEIR PART OTHERWISE. 

1. I have no physical or mental illness that precludes my participation in a safe manner for myself or others. Further I assert that I am physically fit to ride on a boat and to snorkel and should I engage in snorkeling I have the necessary skills to snorkel without assistance.
2. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident and/or illness during the excursion. The Released Parties make no representations implied or otherwise, that the crew can or will perform safe rescue services. I understand that injuries may be compounded by negligent rescue operations and agree not to hold the Released Parties responsible for their actions resulting from any negligent rescue operations.
3. I agree that this Release and Waiver of Liability shall be binding upon my heirs, executors, administrators, successors, assigns and my estate.
4. I will not remove my flotation device at any time while in the water. I acknowledge that doing so will constitute a violation of safety rules and procedures for which I expressly accept the risk.
5. I fully understand that participating in snorkeling requires the use of a snorkel mask that may require covering my entire face and may cause feelings of panic or claustrophobia. (Persons who suffer from claustrophobia are advised not to snorkel).
6. I understand that photographs or video/sound footage taken of me on this excursion by the Company’s agents/assigns may be posted on social media and may be used for marketing purpose without payment.
7. I fully understand that there are no refunds under any conditions once the excursion has left Nassau.
8. I understand that in the event I fail to embark the boat for return to Nassau at the appointed time of departure, the Released Parties shall not be liable for any injury, damage or cost associated with my actions.
9. I understand that I have a duty to exercise reasonable care for my own safety and the safety of any child(ren) that I bring on the excursion.
10. I understand that the minimum drinking age in The Bahamas is 18 years. I acknowledge that I am 18 years or older and agree not to provide alcohol to anyone under the age of 18.
11. I have carefully read this agreement, fully understand its contents and agree to the terms and conditions of this agreement on behalf of myself, my heirs, and personal representatives. I AM AWARE THAT THIS IS A COMPLETE RELEASE OF LIABILITY AND A LEGALLY BINDING AGREEMENT AND I SIGN IT ON MY OWN FREE WILL.
